CONCORD, N.H. — A former psychologist in Keene, N.H., is again facing sexual assault charges involving a former client.
Burton Hollenbeck was charged in April 2010 with 30 counts of aggravated felonious sexual assault against a woman he had treated in 2007.
Under state law, it’s illegal for health care providers or therapists to have sex with former patients within a year of ending treatment when doing so is not recognized as professionally ethical.
Hollenbeck argued that the law was unconstitutional, however, and a superior court judge dismissed the charges.
But in a 4-1 decision Wednesday, the state Supreme Court reversed that decision and reinstated the charges. Hollenbeck’s lawyer, Cathy Green, said she was disappointed in the ruling but confident that her client will be exonerated.
