AUGUSTA — A prosecutor in Kennebec County Superior Court has filed a dismissal of pending burglary, criminal mischief and theft charges against Richard E. Rice, 47, of Waterville.

Rice had been charged in a January indictment in connection with an April 10, 2012, break-in at Dunkin’ Donuts on College Avenue in Waterville.

However, an assistant district attorney dismissed the charge on April 18, citing insufficient evidence.

Jessica J. Savage, 32, formerly of Waterville, pleaded guilty to that burglary in January after her DNA was found on a flip-flop sandal left behind by the burglar, prosecutors said.

At that hearing, Assistant District Attorney Tracy DeVol said Savage smashed a window to enter the store, hopped over the counter and passed the cash box out through the broken window. The break-in was recorded on video.

Rice’s attorney, Lisa Whittier, said the video surveillance showed Savage breaking in but no evidence against Rice.
