SCARBOROUGH — A lawsuit by a transgender man contends he was sexually harassed, demoted and fired after being outed by his manager at a Dunkin Donuts in Scarborough.

Kye Hubbard contends he was called transphobic slurs by co-workers, demoted from his shift leader position after complaining to management and ultimately fired about a week after he told management that he had reported the harassment to the Maine Human Rights commission, the Bangor Daily News reported.

Hubbard, of Westbrook, said he was told he was fired for vaping, but said vaping behind the store, out of customer view, was permitted. He also contended other employees had vaped without repercussions.

The lawsuit named Massachusetts-based franchise operator Cafua Management Co. LLC and a subsidiary that owns the Scarborough store. Cafua Management Co. declined comment because of the pending litigation, the newspaper reported.

A company spokesperson said Dunkin franchises are independently operated but that the company and franchisees “have a longstanding history of embracing diversity.”

“Discrimination is completely inconsistent with our values, and we strive to create inclusive work cultures,” said Michelle King, the spokesperson.
