Dear Sir,

We are writing today in response to your quixotic legal fight to overturn the presidential election. That fight includes lodging a lawsuit at the Supreme Court against four states, Georgia, Michigan, Pennsylvania and Wisconsin, that, if successful, would invalidate as many as 10 million ballots cast legally by Americans who have a right to vote and a right to be heard.

As the state’s attorney general, you have the power to file lawsuits, to pursue every opportunity to combat injustice, and to ensure the law is faithfully and objectively applied. You might think this power gives you the authority to file your suit seeking to change the results of the presidential election, but in fact your lawsuit represents a significant blow to the rule of law in our country, and therefore your suit is the actual threat to our electoral system.

As we’ve noted weeks ago, the election results were clear, even as they were close in several key states. Joe Biden carried more than enough states to prevail in the Electoral College and will, therefore, become the 46th president of the United States on Jan. 20.

Your lawsuit, as you should know, will fail on the merits. Every piece of evidence shows the same result. Donald Trump lost this election. This is why the high court will turn you away, as courts have repeatedly turned away suits seeking to reverse the election’s outcome.

That is not to say that your decisions are without consequence. As the state’s attorney general, you chose to mislead the public by acting as if there were a legal case to defy the will of the voters as expressed through legally administered elections, and this will cause lasting damage to our political system and to faith in our elections. Much like crying wolf when there is no animal in sight, your lawsuit will undermine legitimate complaints in the future about voter fraud and undercut legitimate work in the future to ensure ballot integrity.

Your leadership is also fueling cynicism, empowering conspiracy theorists who operate on accusation rather than fact, and enabling those who seek election confusion rather than clear, compelling and accurate election results. This is leadership unbecoming of your office. It is a disservice to Texans who deserve a well-run office of the attorney general and who depend on a fair administration of justice.

On a personal note, we also would suggest that this lawsuit and your performance generally are not in keeping with the high ethical standards we have a right to demand from people in the law profession and from people entrusted with high office.

Our request is this: Immediately withdraw your lawsuit and make a public statement about the presidential election that is based on facts, note the results and who the next president of the United States will be, and then step back. We are already on record calling for you to step down from your office, so we will only note here that you are proving the wisdom of that position with each passing day.

In any case, even while we recognize you intend to remain in office, we ask that you make a public declaration about the presidential election as quickly as possible so as to make plain to the public and the country at large that the law will prevail and be supported by the state of Texas.
