AUGUSTA — An Augusta man arrested in May on charges alleging he threatened to kill a woman while brandishing a gun was recently indicted by a grand jury on charges he also raped the woman after he allegedly caused her to be impaired.

Ray C. Mack, 28, was indicted by a Kennebec County Grand Jury last week on two counts of gross sexual assault and one count each of criminal threatening with a dangerous weapon and possession of a firearm by a prohibited person.

The gross sexual assault charges allege Mack, on or between May 24 and 26, engaged in a sexual act with a woman who was unconscious or otherwise physically incapable of resisting and who had not consented to the sexual act. The indictment states that he allegedly impaired the woman’s “…power to appraise or control her sexual acts by furnishing, administering, or employing drugs, intoxicants, or other similar means.”

Mack was arrested in May by Augusta police who alleged, according to court papers, he had threatened to kill the woman while brandishing a gun, after he and another man discovered a text message on her phone from a friend of hers that said she would report drug dealing involving the three of them to police.

Police secured a search warrant and arrested Mack after searching a Waldo Street apartment where police said they found a handgun.

The possession of a firearm by a prohibited person indictment alleges Mack was in possession of a gun and he had been convicted, or found not criminally responsible by reason of insanity, of burglary, 2nd degree, in 2010 in New York.

An indictment is not a determination of guilt but indicates enough evidence exists for a case to proceed to trial.
