SKOWHEGAN — A Canaan couple arrested in March on charges they allegedly kicked in the door at the home of another couple, assaulted them and fled with their 4-year-old son has been indicted by a Somerset County grand jury.

Emily Hartley, 19, and her fiancé, Justin Baker, 22, are charged separately in the indictments.

Hartley and Baker are charged with felony burglary, felony criminal trespass and felony criminal restraint for allegedly taking the child. They are charged additionally with two counts each of assault and one count of criminal mischief. The events are alleged to have taken place March 24 in Canaan.

The events triggered a report of a domestic disturbance on Hinckley Road in Canaan. The police report stated that Hartley and Baker allegedly had taken the 4-year-old boy by force, while physically assaulting the child’s parents.

Five county deputies responded to the report, discovering that the child had been taken to a home on Easy Street in Canaan. Hartley reportedly told investigators that she suspected, but had no proof, “that something bad may have happened to the child in the past and she made the decision to go get the child.”

An indictment is not a finding of guilt, but is a determination that there is enough evidence in a case to proceed with trial.
