AUBURN — A Turner man accused of fatally shooting his wife is headed back to court where his lawyer is expected to ask a judge to dismiss as evidence statements he made to police because he wasn’t properly advised of his constitutional rights.
The Sun Journal reports that Brian Nichols is scheduled for a 1 p.m. hearing in Androscoggin County Superior Court today. His trial is scheduled to start next month.
Authorities say the 46-year-old Nichols admitted to police that he killed his wife, Jane Tetreault, in May 2010 because he thought she was having an affair.
In January, Nichols changed his plea from not guilty to not criminally responsible by reason of insanity.
Prosecutors say at least three psychological evaluations have found that Nichols is competent to stand trial.
