AUGUSTA — A Litchfield man was indicted Friday on charges he received more than $10,000 in public assistance over a five-year period by falsely claiming that his only income was from Social Security or other public assistance.

Philip Justin Fitzherbert, 29, who formerly lived in West Gardiner, is charged with six counts of theft by deception, five counts of unsworn falsification and one count of attempted theft by deception.

According to the Kennebec County grand jury indictment, Fitzherbert failed to report annuity payments he received and failed to say that twin daughters, born in June 2013, were not living with him.

Supporting documents show that Fitzherbert told state workers in his application for food supplements, cash and MaineCare benefits that he was living in a camper trailer and received $700-800 a month from various Social Security programs between June 1, 2008, and Nov. 1, 2013.

An indictment is not a determination of guilt, but it indicates that there is enough evidence to proceed with formal charges and a trial in superior court.
