AUGUSTA — A Clinton man was indicted Friday on charges that accused him of injuring two men with a baseball bat last April in Albion.

Jeremy Richard Brown, 30, faces two counts of aggravated assault from an incident April 16 that left one man in a medically induced coma for days, according to a prosecutor at a bail hearing last week. Another man was also named as a victim in the second count.

Each charge carries a maximum penalty of 30 years in prison.

Brown had been free on bail on the aggravated assault charges when he was arrested July 18 in Waterville on charges of operating under the influence, operating after suspension and violating conditions of release.

On Thursday at a hearing at the Capital Judicial Center, Brown’s attorney, Charles T. Ferris, asked a judge to set a cash-only bail for Brown since Maine Pretrial Services rejected him as a candidate for supervision. A judge on Monday had required the latter component.

Ferris told Judge Evert Fowle that Brown had disarmed the alleged victim of the baseball bat attack and should be allowed bail on the newer charges.

“Frankly, this was a pretty big lapse of judgment,” Ferris said. “He had been out and there were no further acts of violence.”

Prosecutor Assistant District Attorney Tracy DeVol said Brown hasn’t had a license since 2010.

“The state considers this very serious,” she said.

Fowle set Brown’s bail at $4,000 cash with a number of conditions, including prohibiting Brown from having contact with the men named as victims in the assault charges as well as from possessing weapons.

Brown has yet to be arraigned on the indictment and remained in the Kennebec County jail on Monday.

An indictment is not a determination of guilt, but it indicates that there is enough evidence to proceed with formal charges and a trial.
