AUGUSTA — The two men convicted of engaging a prostitute were back in court Monday to face a new fine imposed by a state law that went into effect in 2014.

Patrick E. Cazemajou, 51, of Camden, and Walter G. Esancy, 54, of Appleton, had pleaded guilty on Nov. 30 to the charge and immediately went into custody to serve their 48-hour sentences. They also were fined $500, and with court surcharges and victims fees, ordered to pay $620.

On Monday, they were sentenced again. This time, they were told they had to pay a $500 special assessment for the Class E misdemeanor offense, and Judge Evert Fowle reduced the fine to $100 so that with the assessment and surcharges, they owe $620. They were each given credit for the 48 hours served.

“When people come in and negotiate with the district attorney and take their punishment, that should be final,” Fowle told one of them on Monday morning during a hearing at the Capital Judicial Center.

At the hearing, Esancy told the judge that when he came to court a week ago and pleaded guilty, he expected it to be over.

After Monday’s hearing, Esancy said he did not want to speak further about the issue, and Cazemajou left without saying anything.

The additional $500 fee was authorized by a law that went into effect May 12, 2014.

Mary Ann Lynch, government and media counsel with the Administrative Office of the Courts, said Friday that court clerks discovered that it had not been imposed in the two cases handled Nov. 30 in Augusta.

She said the offense is flagged in the Maine justice information system as carrying a fee that cannot be waived.

The two men were among nine men charged with engaging a prostitute on Sept. 17 in Augusta following a sting conducted by police departments in Augusta and Waterville and the Kennebec County Sheriff’s Office.
