A Rochester, New York, man will serve 30 months in prison for selling drugs from the back bedroom of an Augusta apartment.
Charles Fitzgerald Evans Jr., 26, pleaded guilty last week at the Capital Judicial Center to unlawful trafficking in heroin and agreed to criminal forfeiture of $3,617 in cash seized in a police raid April 26, 2016.
According to an affidavit filed in the court, Evans used the back bedroom of a Middle Street apartment to sell drugs.
His case was scheduled for jury selection that day; however, he opted to plead guilty for a recommended 30-month sentence, which the judge accepted.
The prosecutor was Assistant District Attorney Kate Marshall, and Evans was represented by attorney Andrew Edwards.
Evans has been in jail since April.
The affidavit by Augusta police Officer Matthew Estes says police found Evans in the bedroom of Clover Sue Baxter’s apartment, and Baxter, 28, told police she allowed men from New York to use her apartment to sell drugs and got heroin for doing so. Charges against Baxter are pending.
During the raid, police reported finding three bags of heroin packaged for individual resale as well as a ledger, packaging materials and drug paraphernalia. The affidavit says police conducted a controlled buy, using a confidential informant to obtain crack cocaine and heroin from Evans via Baxter and her boyfriend, Leo C. Dyer IV, 31, of Augusta. Dyer also was charged with drug trafficking.
Evans also faces a charge of criminal possession of a controlled substance in New York, where he has previous convictions for driving violations, according to documents in the court record.
