AUGUSTA — Brandon M. Ervin, 21, of Waterville, pleaded guilty Tuesday in Kennebec County Superior Court to theft by unauthorized taking or transfer, which occurred April 23 in Waterville.
He was sentenced to three years in jail, with all but 60 days suspended, and two years’ probation.
He was also prohibited from using or possessing knives, swords or firearms.

in mistrial
AUGUSTA — A mistrial was declared Thursday in a case in which Albert E. Barry, 76, of Farmingdale, was accused of operating under the influence.
Barry was on trial Wednesday and Thursday in Kennebec County Superior Court. The jury deliberated more than four and a half hours before the mistrial was declared.
According to the complaint, the offense occurred Jan. 27, 2011, in Gardiner.
