A Waterville man who allegedly struck a woman with a chair and then held her down with it — and later wrestled with police as they tried to arrest him — has been indicted on charges of aggravated assault, domestic violence assault, criminal mischief and refusing to submit to arrest or detention.

Kevin W. Henderson, 47, was arrested March 3 and initially charged with domestic violence assault. He was indicted last week by a Kennebec County grand jury on the new charges, including the Class A aggravated assault charge, which is punishable by up to 30 years in prison.

Henderson was also arrested on a charge of aggravated assault in 2015, when the same woman accused him of hitting her in the head with a hammer. The aggravated assault charge was dismissed in that case, and Henderson pleaded guilty in 2016 to the lesser charge of assault. He was sentenced to three years in prison, with all but 110 days suspended, and two years probation, according to a criminal records check.

In the recent case, Waterville Police responded March 3 to a 911 call from a woman at 12 Elm St., who was screaming and who dispatchers said sounded like she was being assaulted.

The woman later told police Henderson became agitated and locked himself inside her apartment bathroom and broke things, according to an affidavit filed by Officer Nathan Bernier of the Waterville Police Department. Henderson then began stabbing cardboard boxes with a knife, and went into her bedroom and broke her television and Xbox game console, the woman said.

She told police Henderson then “picked up a chair and struck her with it, and then pinned her to the ground with the chair, not allowing her to get up,” according to the affidavit.

Police said when Henderson removed the wooden chair, the woman called 911, but while she was still on the telephone with the dispatcher, Henderson kicked her several times when she was on the floor and refused to let her leave the bedroom.

When police arrived and sought to arrest Henderson, “Kevin started to pull away and bring his hands up in a manner that led me to believe he was going to punch me. I yelled at him to put his hands behind his back, however he refused,” according to Bernier’s affidavit.

The officer said he forced Henderson to the ground, but the suspect continued to flail and fight, and appeared to be trying to reach for something under a bed.

Other officers arrived, including one who “sprayed” Henderson. The affidavit does not specify what substance was sprayed, but notes it seemed to have had little effect on the suspect.

Police were later able to gain control of Henderson and place him in handcuffs. Officers said it appeared Henderson was intoxicated and on drugs, which had impaired his ability to feel pain.

The affidavit states Henderson has an extensive criminal record, including criminal mischief, assault, theft, violation of conditions of release and a 2014 conviction on a domestic violence assault charge.

An indictment is not an indication of guilt, but indicates enough evidence exists for a case to formally move forward toward trial.

Henderson’s indictment was among many handed up last week by a Kennebec County grand jury.
