AUGUSTA — An Augusta man was indicted last month on charges he attempted to rape a woman July 1 after pushing her off the Kennebec River Rail Trail.
James W. Oliver, 57, described by police and in court documents as transient, is accused of pushing a woman off the rail trail and into the brush, where he tried to pull her shorts down, forced his hand under her shorts and underwear and stated he was going to rape her, according to the indictment by a Kennebec County grand jury issued last month.
Police said a pedestrian rushed to the aid of the woman, interrupting the assault.
Oliver was indicted on two counts of attempted gross sexual assault, and one count each of unlawful sexual contact, criminal threatening, and assault, all counts involving the same victim July 1. The charges allege he had sexual contact with the woman, who did not consent to that contact.
Oliver was previously convicted of gross sexual assault and unlawful sexual contact, in 2015 and 2011, respectively, according to court documents.
One of the two attempted gross sexual assault charges is a Class A charge, punishable by up to 30 years in prison.
Oliver was also indicted on other charges that same day that don’t appear related to the incident on the trail. Those charges are burglary, theft by unauthorized taking, and criminal mischief, allegedly at MD’s Market.
An indictment is not a determination of guilt, but indicates enough evidence exists for a case to move toward trial.
